Doris Tennant Speaks about High Conflict Case Resolved Using Collaborative Process

The Urban Practice Group of the Massachusetts Collaborative Law Council heard a case study and discussion presented by Attorneys Rachel Goldman and Doris Tennant, joined by Dr. Sandy Portnoy. Despite being an unlikely candidate for the collaborative process, this complex and highly conflicted case served as a great example of the power of the collaborative process. The attorneys and divorce coach were able to "create a space for the conflict to allow the clients to do their best," and they rose to the occasion. Some pearls derived from the discussion -- be steadfast in letting the parties express very painful emotions, then help them manage those and make rationale decisions. Also, attorneys should avoid negotiation outside of the four-way meeting, as it undermines the process.
